In his March 17 commentary, George Weigel stated that one man, Justice Anthony Kennedy, decided Obergefell v. Hodges. In fact, the case was decided by a vote of 5 to 4. Justice Kennedy wrote the majority opinion on behalf of five justices. Please note that, under normal Supreme Court practice, the Chief Justice, John Roberts, selects the justice to write the majority opinion.
